(MYFOX NATIONAL) - After an intense night of drinking, David and Deanne Elsholz got into a contentious dispute, ending in physical harm and an assault charge, reported the St. Petersburg Times .
The fight started just before midnight on Feb.15, when David Elsholz apparently got up to urinate. To Deanne Elsholz’s chagrin, however, he urinated on the bathroom floor.
According to the police report (PDF document) and a report by WTSP-TV , Mrs. Elsholz asked what he was doing and began to yell. Mr. Elsholz mentioned that he “didn’t want to argue and just wanted to sleep.”
As both were intoxicated, she continued yelling and picked up a glass cup, throwing it at Mr. Elsholz and causing his nose to bleed severely.
According to Mrs. Elsholz, she ran into the bathroom and slipped on David’s urine. At that time, Mr. Elsholz came up to her and began kicking her repeatedly in the ribs.
It was at this time when Mrs. Elsholz crawled to the phone to call 911. When authorities arrived, she seemed distraught. Her answer kept changing when it pertained to her husband hitting her with a towel. Police observed no injuries or redness to her face or back, while fire personnel declared her to be in “fine” condition.
"I was unable to locate the glass cup in the bedroom,” says the arresting officer. “It should also be noted there was a large quantity of empty Natural Light cans throughout their bedroom and rest of the house," according to the arrest affidavit . "Both Deanne and David appeared to be extremely intoxicated."
Once all possible injuries were cleared, Mrs. Elsholz was determined to be the aggressor in this case. She was arrested by police and has since been charged with domestic battery, which her husband has been twice charged with in the past. She is currently being held without bail in the Land O’Lakes local prison.
